道路を規定する制度の中心には「道路法」がある。しかしその制定は大正8年(1919)であり，それ以前は布達によって国道，県道，里道にわけられていたに過ぎない。狭い幅員の道路は里道に該当するが，その幅員は大正8年法には定められていなかった。今日では道路構造令によって特例として4mのものも認められているが一般には5m以上とされている。一，「建築基準法」には敷地との関係において道路幅員が決められており，その道路が公道であるか私道であるかは問わず，4m未満の幅員の道路に沿っては原則的に建築が許されない。しかし同法では例外規定として，以前から存在した4m未満の道路については，現存する建築物を違反とみない救済措置が定められており，建替え時等に道路中心線から2m後退すればよいとされている。これがいわゆる二項道路 (同法第42条第2項の道路。みなし道路ともよばれる)である。この二項道路の4mへの拡幅が建築基準法施行後約30年が経つにもかかわらずあまり進んでいないこと，二項道路以外にも道路法はもちろんのこととして建築基準法にも規定され難い道路や，制度上は適法とされながらも実態上は基準を満たしていない道路が多数存在すること等々を「狭隘道路問題」と総称することが可能であろう。これは単に制度上の問題としてのみでなく，過密市街地の居住環境整備という都市計画課題においても重要な問題として捉えられる。本稿ではこれら狭隘道路問題に関して行ったいくつかの調査を素材としながら制度論，実態論，計画論において考察し，その今後の解決方向についての検討を行った。 |

The former Road Act of 1919 did not contain a regulation on the wibth of roads. After that，the Road Act of 1952 and the Regulation of Road Structure of 1958 fixed the minimum width of roads at 5 meters. On the other hand，the Building and Zoning Act of 1950 has to be considered in the case of roads not less than 4 meters in width. But there were many sites which were not connected with the road more than 4 meters in width，so the regulation mentioned above all is an article for exception. The roads in exception are covered by the “42ー2road clause” which indicates that the building border on such a road must lie 2 meters back from the center line of the road at the time of rebuilding. In this paper the authors intend .to consider the problems related to city planning. The materials of this study were obtained from their own study entitled “Surveyon Narrow Roads in Ohta Ward”，that had been carried out in 1979. The main conclusions of this paper are as follows; 1) The situation on the regulations or the planning of these roads are not at all. 2) The problems presnted by the 42-2 road clause lie in the fact that the location of these roads are not distinct and most of them have not been widened for the past 30 years. 3) A solution will be obtained in confirming the location of these roads，and then deciding which roads must be widened from the viewpoint of distinct planning at any cost. |
