 note = {大震災発災(1995年1月)後に展開した都市土地法・国土法を詳細に検証するに、確かに防災は都市づくりに際するスローガンとして強調される場面は増えるが、地震を大災害に直結させた都市構造とそれを驚した都市法・都市政策という根本的な反省の観点から見れば、大震災の影響は微慶も見られず、その後一層深化した「規制緩和」の大合唱と「地方分権」のスローガンの下に、都市を営利を求めグローパルに展開する事業者に好都合に再編するためにますます都市空間の高密化を促し都市内に危険を蓄積する都市土地法の改変が進み、国土法・国土政策も野放図な開発志向に媒介されるようになる。今や、曲がりなりにも一応の体系性をもって整備されてきた都市計画法を中心とする戦後都市土地法制は、全面崩壊の一歩手前にさしかかっている。その底流には、都市空間を私的空間としてますます強く囲い込みその素材をなす土地も金融資産として捉え、これをできるだけ流動化して再びマネーゲームの柑桶に投げ入れる志向がある。都市計画法に大きな改変を加えた2000年改正法は、こうした世紀末土地法・都市政策の延長上にあって中間総括をなし、基本的にはそれを推し進める働きを持ち、都市危険累増の歯止めにはならないであろう。都市防災の向上、言葉の本来の意味での「災害に強い都市づくり」のためには、四半世紀にわたって続けられてきたこういった極端な危険累積促進型の都市政策と土地法を抜本的に改め、都市空間の本来的公共性と有限な自然の一部であり人聞社会の共同資源であって本来的商品ではない土地の公共性に鑑み、都市住民と都市事業者・勤労者にとってアメニティーが高くなり、地域コミュニティーが活性化される都市政策と土地法に切り換え、都市の高密化を極力計画的に抑えなければならない。, Reviewing the development of urban land acts and land development acts in detail after the Great Hanshin-Awaji Earthquake Disaster of 1995, we cannot find any serious reflection on the disaster in these acts, in terms of studying the lessons of the terrible disaster such as fragile urban structures, in spite of general stressing of urban disaster prevention in urban public policies: La finde- siecle reformation of urban land law has accelerated high density of urban space, has accumulated quite high disaster risks in towns and cities and land use law / policy has oriented by baldly wild urbanism under the slogans of “de-regulation" and ”de-centralization". Now Japanese postwar land use systems are to be broke down totally. There lies a strong stream which would privatize urban spaces more firmly and take urban land for financial assets as well as liquidate ones as much as possible to throw into melting-pots of money-games. In order to promote urban disaster prevention and remake our towns and cities strong against disasters in a real sense, we have to switch from such extremely dangerous urban policies and urban land laws to another way to promote amenities of urban residents and urban workers, to activate neighborhood communities, to restrain systematically from high density spaces such as downzoning, increasing open-spaces, etc. as much as possible, to take urban spaces back to urban residents / workers from global businesses, in terms of the communal status of urban spaces in proper, and communal resources of land in proper as well., postprint},
